Compensation for criminal proceedings

The State is responsible for its unlawful actions



The State can interfere in a very serious way with the rights of persons directly affected by criminal proceedings. If such interference is unlawful, the person affected is entitled to compensation.

In this context, there is a special law regulating the method of compensation. In particular, the conditions for the establishment of the State's liability for the damage caused, certain special provisions on the scope of compensation, limitation periods, or the obligation to first submit a claim for compensation to a certain authority (in the case of damage incurred in criminal proceedings, the Ministry of Justice).
